Non-Renewal timelines
Teachers
- January 15.....First evaluation must be conducted and completed no later than January 15 of year in which board may wish to nonrenew.
- January 25.....Teacher must receive written report of evaluation results no later than January 25.
- February 10 to April 1.....Second evaluation must be conducted and completed between February 10 and April 1.
- April 10.....Teacher must receive written report of second evaluation no later than April 10.
- April 30.....Teacher must receive written notice of nonrenewal on or before April 30.
- 10 days.....Teacher may demand written statement describing the circumstances that led to board's intention not to reemploy within 10 days of receipt of nonrenewal notice.
- 10 days.....Treasurer must provide written statement to teacher within 10 days of receipt of demand.
- 5 days.....Teacher may demand hearing within 5 days of receipt of written statement.
- 10 days.....Treasurer provides written notice to teacher of time, date, and place of hearing within 10 days of receipt of demand.
- 40 days.....Hearing must be scheduled and concluded within 40 days of receipt of demand.
- 10 days.....Board must provide written decision within 10 days of conclusion of hearing
- 30 days.....Teacher may appeal order affirming nonrenewal within 30 days of receipt of notice.
When must we notify other employees of nonrenewal?
- Superintendent-March 1
- Other administrators(assistant superintendent, principal, etc.)-March 31
- Nonteaching employees(bus driver, secretary, cafeteria worker, etc.)-June 1-However, unemployment compensation laws require notification by April 30. Because of this apparent conflict, we would suggest that you notify by April 30.
Are personnel files public records?
The answer is clearly "yes." Public records are defined as any record kept by a school district, with limited exceptions, including medical records, social security numbers and student records. Therefore, evaluations, payroll information, letters of reprimand, etc., are all open to public inspection.
